1. Who these terms are with

GamersHell.com (the "Service") is operated by an independent team based in the Isle of Man, British Isles ("we", "us", "the operator"). By using the Service, you accept these Terms & Conditions. If you do not accept them, please do not use the Service.

2. The Service

GamersHell is a free online catalog of browser games, with optional user accounts that let you submit reviews, ratings, and leaderboard scores. We do not charge for any feature. We do not run advertising on the GamersHell-hosted pages themselves.

Games are provided through licensed embeds from third-party publishers (including but not limited to GameMonetize, GameDistribution, and GamePix). The games themselves remain the property of their respective developers and publishers.

3. Accounts

You may create an account using an email address and a username of your choosing. You are responsible for keeping your login credentials confidential. You are responsible for all activity that occurs under your account.

You agree to provide accurate information when creating an account. You agree not to use the Service to impersonate another person, and not to create multiple accounts to circumvent moderation actions taken against an earlier account.

You may delete your account at any time. See our Privacy Policy for what we do with your data after deletion.

4. Acceptable use

When using the Service — including when submitting reviews, ratings, scores, profile bios, or any other user content — you agree not to:

• Post content that is illegal, defamatory, threatening, harassing, hateful, or that infringes anyone's privacy or intellectual property rights
• Submit fraudulent leaderboard scores or use automation to inflate scores
• Attempt to gain unauthorized access to the Service, other users' accounts, or our backend systems
• Use the Service in a way that disrupts, overloads, or impairs it for other users
• Scrape, crawl, or otherwise extract bulk data from the Service for commercial purposes without our written permission
• Reverse-engineer any part of the Service that is not openly published
• Use the Service to distribute malware, spam, or unsolicited advertising

We reserve the right to remove content, suspend or terminate accounts, and refuse service to anyone who violates these rules. We will, where reasonable, give you a chance to address the issue before taking permanent action.

5. User content

You retain ownership of the reviews, ratings, profile bios, and other content you submit ("User Content"). By submitting User Content to the Service, you grant us a non-exclusive, royalty-free, worldwide license to display, store, and distribute that content on the Service for the purpose of operating it. This license ends when you delete the content, except for backups retained per our Privacy Policy.

You represent that you have the right to submit any User Content you post, and that it does not infringe anyone else's rights.

6. Intellectual property

The GamersHell name, logo, site design, original editorial copy, taxonomy, and software are owned by the operator and are protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from these elements without written permission, except for ordinary browsing and personal non-commercial use.

Game content (artwork, gameplay, code) belongs to the original game developers and publishers. Game thumbnails and titles are used under license from the respective providers.

If you believe content on the Service infringes your copyright, please send a notice to [email protected] with the subject line "Copyright notice", including: a description of the work you claim was infringed, the specific URL on GamersHell where the infringement appears, your contact details, and a statement that you have a good-faith belief that the use is not authorized.

7. Third-party content and games

Important: GamersHell embeds games provided by third parties. When you play an embedded game, that game runs inside an iframe served from the provider's own infrastructure. The provider may show its own advertising inside that iframe, may use its own cookies, and may apply its own terms of service.

We do not endorse, control, or guarantee the content of third-party games or any advertising they display. We are not responsible for harm arising from your use of third-party games, advertising, or any external sites linked from the Service. We do not warrant that any third-party game will be available, bug-free, or fit for any particular purpose.

If you encounter a broken game, harmful advertising inside a game iframe, or content that violates these terms, please report it to [email protected].

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific game will be available, work in your browser, or remain in the catalog. We do not warrant the accuracy, completeness, or usefulness of any content on the Service, including User Content and game descriptions.

You use the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any direct damages, regardless of the cause, is limited to the amount you have paid us in the past 12 months — which, given that the Service is free, is zero.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, gross negligence, or death or personal injury caused by our negligence.

10. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your breach of these terms, your User Content, or your misuse of the Service. This indemnity does not apply to claims arising from our own negligence or wilful misconduct.

11. Termination

You may stop using the Service at any time. You may delete your account at any time via [email protected].

We may suspend or terminate your access to the Service if you breach these terms, or if continuing to provide the Service to you becomes impractical or unlawful. We will give reasonable notice where possible, unless we need to act immediately to protect the Service or other users.

Sections 5 (User Content licenses you've granted, with respect to content still on the Service), 6 (Intellectual property), 8 (Disclaimer), 9 (Limitation of liability), 10 (Indemnity), and 14 (Governing law and disputes) survive termination.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and, for changes that meaningfully affect your rights, we will notify account holders by email at least 14 days before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the new terms.

13. General

If any provision of these terms is held to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

14. Governing law and disputes

These terms are governed by the law of the Isle of Man. Any dispute arising out of or in connection with these terms or the Service is subject to the exclusive jurisdiction of the courts of the Isle of Man. If you are a consumer resident in the European Union or United Kingdom, this clause does not deprive you of any mandatory consumer-protection rights you have under your local law.
